First, cable franchises popped up as early as 1992, and our street was cabled in 1995-ish, the week after I'd finished college and wanted lots of lie-ins. There were loads of smaller franchises, who were gradually bought by bigger franchises. Telecential were bought by Comtel who were bought by NTL who are now Virgin Media. Jones Cable were bought by Bell Cablemedia, who were bought by Cable & Wireless who became Telewest who are now Virgin Media.
Second, the network technology required *country-wide* to offer a differing service level to somebody based on the MAC address of their CPE is silly. A database of MAC addresses, which you've got to filter by company down to product - it's stupid. What about everyone else who runs a router on a Virgin Media connection who's not had a problem? The author didn't think their router was... possibly... shock horror... PERFORMING BADLY WHEN IT RECEIVED LOTS OF ARP PACKETS, AS YOU DO ON A CABLE NETWORK.

2) The article doesn't mention MAC adress. But the comments there are illuminating, e.g. "The network is sufficiently busy failing in other places that Virgin Media almost certainly don't have the time, resources, or inclination to scan for routers and impede their connection."
The other criticisms, I think, stand.
